1.1 Service or Services means any rubbish removal, waste clearance, bulky waste collection, recycling, loading, transportation, or associated work carried out by or on behalf of Rubbish Removal Maida Vale.

1.2 We, Us, Our means Rubbish Removal Maida Vale, the service provider.

1.3 You, Your, Customer means the person, business, or organisation requesting or receiving the Services.

1.4 Premises means the location where the Services are to be provided, including any access routes, driveways, gardens, outbuildings, internal areas, or communal spaces.

1.5 Waste means any items, rubbish, junk, furniture, appliances, garden waste, construction debris, or other materials agreed to be collected and removed by Us.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services, including but not limited to household clearances, garden waste removal, office and commercial clearances, bulky item collection, and general rubbish removal within our operational area including Maida Vale and surrounding districts.

2.2 The precise scope of the Service will be set out in the booking confirmation or as otherwise agreed between You and Us prior to the start of the work. Any items or work not expressly listed are excluded.

2.3 We reserve the right to refuse to remove any Waste that is not safely accessible, is not as described at the time of booking, is prohibited by law, or poses a health, safety, or environmental risk to Our staff or the public.

3. Booking Process

3.1 You may request a quotation or book Services by telephone, email, or other communication methods that may be made available from time to time.

3.2 You must provide accurate information about the type, approximate volume or weight, and location of the Waste, along with access details, parking restrictions, floor levels, and any other relevant information. Our pricing is based on these details; inaccurate information may lead to changes in the final price.

3.3 Any quotation given prior to our arrival is an estimate only and is subject to change after an on-site assessment of the Waste. We will confirm the final price before commencing work. If You do not agree to the revised price, You may cancel the Service at that point without charge, provided no work has started.

3.4 A booking is confirmed when We have accepted Your request and provided a date and, where possible, a time window for the Service. Confirmation may be given verbally or in writing. We are not obliged to attend until the booking has been confirmed.

3.5 You must ensure that an authorised person is present at the Premises at the agreed time to grant access, confirm the items to be removed and, if required, make payment.

4. Access, Parking and Customer Responsibilities

4.1 You are responsible for ensuring safe, reasonable, and lawful access to the Premises and to the Waste to be collected. This includes ensuring that any communal areas are unlocked, that keys or access codes are available, and that any obstacles are removed.

4.2 You must inform Us in advance of any parking restrictions, loading regulations, or permit requirements near the Premises. Where parking fees, permits, or fines are incurred due to incomplete or incorrect information provided by You, these may be added to Your final bill.

4.3 You must ensure that the Waste presented for collection broadly matches the description provided at the time of booking and that it is not contaminated by hazardous substances unless previously agreed.

4.4 For safety reasons, Our operatives will not dismantle structural elements of a building, such as walls, fixed ceilings, or permanent fixtures. Minor dismantling of furniture or appliances may be carried out at Our discretion.

5. Payments and Charges

5.1 Our charges may be based on one or more of the following: volume of Waste removed, weight of Waste, type of Waste, labour time, access difficulty, and distance or disposal costs. Any applicable call-out charges, waiting time, or supplemental fees will be explained before work begins whenever possible.

5.2 Unless otherwise agreed in writing, payment is due immediately upon completion of the Service. We may accept payment by cash, card, bank transfer, or other methods notified to You at the time of booking.

5.3 We reserve the right to request partial or full payment in advance, particularly for larger jobs or commercial clients. If advance payment is required and not received by the due date, We may suspend or cancel the booking.

5.4 All prices are quoted inclusive or exclusive of VAT as stated at the time of booking. If VAT is applicable, it will be charged at the prevailing rate.

5.5 If payment is not received when due, We may charge interest on the overdue amount at the statutory rate applicable to business debts, as well as reasonable administrative and recovery costs.

6. Cancellations, Rescheduling and Missed Appointments

6.1 You may cancel or reschedule a booking by giving Us notice as early as possible. We request a minimum of 24 hours notice for standard bookings. For larger jobs, such as full property clearances, different notice periods may apply as communicated at the time of booking.

6.2 If You cancel with less than 24 hours notice, We reserve the right to charge a reasonable cancellation fee to cover Our administrative and scheduling costs, particularly if Our team has already been allocated or is en route.

6.3 If Our operatives attend at the agreed time and are unable to gain access, or if the job cannot proceed due to circumstances within Your control, We may treat this as a missed appointment and charge a call-out or cancellation fee.

6.4 We will make reasonable efforts to attend on the agreed date and within the agreed time window. However, appointment times are estimates only and may be affected by traffic, previous jobs, or circumstances beyond Our control. We will notify You of any significant delays where reasonably possible.

6.5 In rare cases We may need to cancel or reschedule a booking due to operational or safety reasons. In such cases, We will contact You as soon as reasonably possible to arrange an alternative date. Our liability in such circumstances is limited to the rescheduling of the Service or a refund of any amounts paid for the affected booking.

7. Waste Regulations and Prohibited Items

7.1 We operate in accordance with applicable UK waste management laws and regulations, including licensing and duty of care requirements. Waste collected by Us will be transported to authorised disposal, recycling, or recovery facilities.

7.2 Certain types of Waste are classified as hazardous or require special handling and disposal, such as asbestos, chemicals, solvents, medical waste, gas cylinders, oils, and some electrical goods. You must inform Us in advance if any such items are to be removed.

7.3 We may refuse to remove hazardous or specialist Waste if We are not suitably licensed, equipped, or authorised to handle it. Where We agree to collect such items, additional charges and conditions may apply.

7.4 You confirm that You have the authority to dispose of the Waste and that it does not include stolen goods, illegal substances, or any material the possession or disposal of which would constitute an offence.

7.5 Once the Waste has been removed from the Premises and loaded onto Our vehicle, it becomes Our responsibility, and We will manage it in compliance with waste regulations. We may sort materials for recycling or re-use at Our discretion.

8. Condition of Premises and Care of Property

8.1 Our operatives will take reasonable care when carrying out the Service to avoid damage to property or fixtures. However, the movement of heavy or bulky items can present an inherent risk of minor damage, such as scuffs to walls or floors, for which We are not liable unless caused by Our negligence.

8.2 You should take sensible precautions to protect flooring, walls, and fixtures if You are concerned about potential cosmetic damage. You may request that Our team does not move certain items through particular areas, but this may affect Our ability to complete the Service.

8.3 We are not responsible for pre-existing damage to property or items, or for any deterioration that occurs as a result of the normal removal of old, fragile, or poorly installed fixtures and fittings.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions limits or excludes Our liability for death or personal injury caused by Our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be lawfully limited or excluded under UK law.

9.2 Subject to clause 9.1, We are not liable for any indirect, special, or consequential loss or damage, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of data, whether arising in contract, tort, or otherwise.

9.3 Our total liability to You in respect of any claim arising out of or in connection with the provision of the Service shall not exceed the total price paid or payable for the specific job giving rise to the claim.

9.4 We are not liable for any delays or failures in performing Our obligations where such delay or failure is caused by events beyond Our reasonable control, including severe weather, traffic incidents, industrial disputes, acts of government, or utility failures.

10. Complaints and Disputes

10.1 If You are dissatisfied with any aspect of the Service, You should notify Us as soon as possible, and in any event within 48 hours of completion of the job, so that We have an opportunity to investigate and, where appropriate, rectify the issue.

10.2 We may ask You to provide photographs, a written description of the problem, or access to the Premises so that We can properly assess Your complaint.

10.3 We will endeavour to resolve complaints promptly and fairly. Where We agree that a problem has arisen due to Our fault, We may at Our discretion offer a partial refund, a re-visit, or another suitable remedy.

11. Data Protection and Privacy

11.1 We collect and process personal information such as Your name, contact details, and address for the purposes of managing bookings, providing the Service, taking payment, and handling enquiries or complaints.

11.2 We will handle Your personal data in accordance with applicable data protection laws and will only retain it for as long as necessary for the purposes for which it was collected or as required by law.

11.3 We may share Your information with employees, contractors, or service providers who need it to deliver the Service, process payments, or manage Our operations. We will not sell Your personal data to third parties.

12. Amendments to these Terms

12.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, or Our business practices.

12.2 The Terms and Conditions in force at the time of Your booking will apply to that particular Service, unless You agree in writing to a later version.

13. Governing Law and Jurisdiction

13.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

13.2 You and We agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter.

14. General Provisions

14.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

14.2 No failure or delay by Us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

14.3 You may not assign or transfer any of Your rights or obligations under these Terms and Conditions without Our prior written consent. We may assign or transfer Our rights and obligations to another entity as part of a business reorganisation or transfer, provided that this does not reduce Your rights under these Terms and Conditions.

14.4 These Terms and Conditions constitute the entire agreement between You and Us in relation to the provision of the Service and supersede any prior discussions, correspondence, or understandings between Us relating to the same subject matter.
